These Terms of Use ("Terms") govern your use of homerabbit.app (the "Website"), operated by Home Rabbit LLC ("HomeRabbit," "we," "us," or "our"). By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1. What the Website is

The Website provides general information about HomeRabbit. The HomeRabbit app and platform are not yet available. When they launch, separate terms of service will apply to them, and those terms will govern your use of the app and platform.

2. Not professional advice; not for emergencies

Information on the Website is general and for informational purposes only. It is not professional, legal, safety, or engineering advice and is not a substitute for a licensed professional who can assess your home. HomeRabbit is not an emergency service. If you smell gas, see sparking or fire, smell smoke, have flooding, or hear a carbon monoxide alarm, leave the area and call 911 and your utility's emergency line.

3. Eligibility

You must be at least 18 years old to use the Website.

4. Acceptable use

You agree not to:

• Use the Website for any unlawful purpose or in violation of these Terms;
• Interfere with or disrupt the Website or its security, or attempt to gain unauthorized access to it;
• Use automated means to scrape or overload the Website, or introduce malicious code;
• Copy, modify, or distribute Website content except as these Terms allow; or
• Misrepresent your identity or affiliation.

5. Intellectual property

The Website and its content, including text, design, logos, and the HomeRabbit name, are owned by Home Rabbit LLC or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive right to view the Website for your personal, non-commercial use. No other rights are granted.

If you send us suggestions or feedback, we may use them without obligation or compensation to you.

7. Third-party links

The Website may link to third-party sites. We do not control them and are not responsible for their content or practices.

8. Disclaimers

The Website is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Website will be uninterrupted, error-free, or secure, or that its content is complete or current.

9. Limitation of liability

To the fullest extent permitted by law, HomeRabbit and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of or inability to use the Website. To the fullest extent permitted by law, our total liability for any claim relating to the Website will not exceed $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless HomeRabbit and its members, managers, employees, and agents from claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Website.

11. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Website will be brought exclusively in the state or federal courts located in or serving Alachua County, Florida, and you consent to the jurisdiction of those courts.

12. Changes

We may update the Website and these Terms at any time. The "Last updated" date shows the latest version. Continued use after an update means you accept the updated Terms.

13. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy and SMS Terms, are the entire agreement between you and us about the Website.
